Terms of Use

1. Agreement

These Terms of Use govern your use of the mobile applications ABILAND — Toddler Worlds (also named Abiland Kids: Toddler Academy / ABI Worlds) and ABILAND Puzzle (each, "the app"), published by MIDAX STUDIO SRL, registered in the Republic of Moldova, Chișinău ("we", "us", "the Provider"). By installing or using the app you agree to these terms. If you do not agree, please do not use the app.

The app is intended for young children and must be installed and set up by an adult. By using it you confirm that you are the parent or legal guardian of the child who will play, or that you act with their permission.

2. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the app on devices you own or control, for personal, non-commercial purposes.

You may not:

• copy, modify, translate or create derivative works from the app;
• reverse-engineer, decompile or disassemble it, except where that right cannot lawfully be restricted;
• rent, lease, sell, sublicense or redistribute it;
• remove or alter any copyright or trademark notice;
• use it in any way that breaches applicable law.

3. Content and free access

ABILAND — Toddler Worlds contains 18 themed worlds, each with 8 activities — 144 activities in total. The first world ("City") and all 8 of its activities are free permanently, with no time limit and no reduction in features.

ABILAND Puzzle contains 12 themes with 21 pictures each, available in 4, 6 and 8 pieces. The first picture in each theme is free in all three difficulties: 12 pictures and 36 puzzle variations.

4. Purchase

In Toddler Worlds, the remaining 17 worlds are unlocked by a single, one-time, non-consumable purchase. There are no subscriptions, no in-game currency, no loot boxes, no random rewards and no repeat charges of any kind.

• The price shown in the app is the price set by Apple or Google for your country, in your own currency, including any applicable taxes.
• The purchase is tied to your Apple or Google account, not to a device. You can reinstall the app or move to a new device with the same account and the content remains unlocked. Settings contains a Restore Purchases option if it does not restore automatically.
• The purchase screen is placed behind a parental gate, to help prevent accidental access by a child.

In Puzzle, a separate one-time, non-consumable purchase unlocks the remaining 240 pictures. Buying one game does not unlock the other. Restoration is limited to the same game and the same store account on a compatible device. Purchases do not transfer between Apple App Store and Google Play. Progress is saved locally and is separate from purchase restoration.

5. Payments and refunds

All payments are processed by the Apple App Store or Google Play. We do not receive, process or store payment details of any kind.

Refunds are therefore governed by the policy of the store you purchased from, and requests must be made to them: Apple or Google Play. If you believe something has gone wrong with a purchase, contact us as well at hello@midax.studio and we will help where we can.

6. Privacy

The games have no ABILAND user accounts or advertising. Details about local progress, purchase services, support correspondence and this website are in our Privacy Policy, which forms part of these terms.

7. Intellectual property

All rights in the ABILAND brand, the user interface, the artwork and characters, the sounds, the source code, and the structure and sequence of the games, their worlds, activities and puzzles belong exclusively to MIDAX STUDIO SRL and are protected by copyright and trademark law. Nothing in these terms transfers any of those rights to you.

8. Availability and changes

We aim to keep the app working on current devices and operating systems, and we may update it to fix problems, improve it or add content. We may also modify or discontinue features. If we ever discontinue the app entirely, content you have already purchased remains playable on devices where it is installed, for as long as the operating system supports it.

9. Warranty and liability

The app is provided "as is". To the fullest extent permitted by law we exclude implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the app will be uninterrupted or error-free.

To the fullest extent permitted by law, our total liability arising out of or in connection with the app is limited to the amount you actually paid for it in the twelve months before the claim arose. Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud.

Consumer rights. If you are a consumer in the European Union, the United Kingdom, or another jurisdiction granting mandatory consumer protections, those rights are unaffected by these terms.

10. Parental supervision

The app includes a parental gate and an optional daily play-time limit, but these are aids, not substitutes for supervision. Parents remain responsible for how, when and for how long their child uses the app, and for the device settings that govern purchases.

11. Termination

This licence ends automatically if you breach these terms. You may end it at any time by uninstalling the app.

12. Additional terms for Apple App Store downloads

Where you obtained the app from the Apple App Store, the following apply and prevail over any conflicting provision:

• This agreement is concluded between you and MIDAX STUDIO SRL only, not with Apple. Apple is not responsible for the app or its content.
• The licence permits use on Apple-branded products you own or control as allowed by Apple’s Usage Rules, including applicable Family Sharing or volume-purchase arrangements. You must comply with applicable third-party agreement terms when using the app.
• Apple has no obligation to furnish any maintenance or support services for the app.
• If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the app.
• MIDAX STUDIO SRL, not Apple, is responsible for addressing any claim relating to the app, including product liability, failure to conform to legal requirements, and consumer protection claims.
• MIDAX STUDIO SRL, not Apple, is responsible for the investigation, defence, settlement and discharge of any third-party intellectual property infringement claim relating to the app.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms and, upon your acceptance, will have the right to enforce them against you.

13. Governing law

These terms are governed by the laws of the Republic of Moldova, without prejudice to any mandatory consumer protection rules of the country in which you reside.
